The Equality and Human Rights Commission (EHRC) warns that the NHS will be “pursued” if gender policies are not changed in a unity space.
Following this week’s Supreme Court decision, the 2010 Equality Act’s definition of women is defined by biological sex, with public bodies, including health services, receiving new guidelines.
Now, the NHS allows trans people to be treated according to their affirmed gender, so the new rules could affect spaces such as changing rooms.
And now, BBC EHRC Chair Baroness Kishwer Falkner said:
She said today If the EHRC does not match the updated Code of Conduct, the program “pursuing” the NHS adds:
An NHS spokesman said the guidance has been reviewed and the process “takes into consideration and takes into account all relevant laws and Supreme Court decisions.”
Despite the verdict, the Gender Recognition Certificate (GRC) remains valid. However, Faulkner suggests that the next step in the case could include testing the legal validity of the document.
Thanks to the Gender Recognition Act of 2004, GRC allows trans men and women to be recognized by how they identify whether it does not match the gender assigned at birth. However, non-binary gender is not legally recognized in the UK, so individuals may be recognized only as male or female.
