Elon Musk has accused him of “trying to sell out” from questions about transgender students who stepped into the Virginia governor’s race to attack Democratic candidate Abigail Spanberger and accessing bathrooms and locker rooms that fit their gender identity. Musk shared a post about X highlighting Spanberger’s response to WJLA reporter Nick Minock. He asked if he supports “biological men who use women’s locker rooms and bathrooms and say they are women who compete in female sports.”
Spanberger said attempts by the future Virginia Governor or the Trump administration to impose a bathroom ban could violate the fourth U.S. Circuit Court of Appeals decision of the 2020 fourth U.S. Circuit Court of Appeals to enable transgender students in Virginia, Maryland, West Virginia, North Carolina and South Carolina to use bathrooms that match their gender identity.
The former lawmaker also pointed to tensions between the binding court ruling that the U.S. Supreme Court repeatedly refused to overturn, and the Department of Education, which is pressing schools, including five districts in northern Virginia, to restrict locker room access based on student biological sex.

The billionaire has a history of intervening in campaigns, often heavier on the X he owns, attacking the “left” on a daily basis. He sometimes invested financially in Republican candidates. Most notably, Donald Trump’s reelection in 2024 and Wisconsin Supreme Court candidate Brad Simel lost earlier this year. Democrats sought to exploit the low recognition ratings of masks by portraying Republicans as funding with impure motivated by wealthy elites.
A Spanberger spokesman rejected Musk’s claim in a statement from Fox News, saying the former lawmaker is the mother of three daughters in a Virginia public school and a former federal law enforcement officer who investigated child predators.
“Nothing is more important than the safety of all children in Virginia,” the spokesman said. “Ultimately, Abigail believes these are decisions between parents and local schools. She believes politicians need to stop politics in Virginia’s public schools.”
Meanwhile, WJLA reporter Nick Minnock repeatedly pushed Spanberger over and over whether he would personally support trans students in making gender-affirming bathrooms and locker rooms available. She has avoided answering primarily.
