Another federal judge in Washington has blocked President Donald Trump’s executive order aimed at banning trans people from serving the military.
This is the second injunction policyJudge Ana Reyes called the ban “inhumous” and said it violated equal rights of protection.
Tacoma-based U.S. District Judge Benjamin Settle said the government has not explained why transgender forces should be banned after members of the trans service were in the military without issue for the past four years.
In his ruling, Settle said: “The government’s argument is unconvincing and is not a particularly close question about this record. The relentless reliance on government’s respect for military rulings is unfair in the absence of evidence to support a new ruling of the “military” reflected in the military ban. ”
Trump signed an executive order on January 27th, with Trans signing “even in his own life, he is at odds with the soldier’s commitment to a lifestyle of honor, truth and discipline,” which is detrimental to military preparation.
This led to Defense Secretary Pete Hegses issued a policy disqualifying all transgender people from military service.
Several longtime transgender military members say the ban is insulting and discriminatory, and their dismissal will cause serious damage to their careers.
Settle highlighted the specific case of U.S. Navy Commander Emily Shilling, a trans woman who has served for nearly 20 years, saying, “There is no evidence that she is, or is, ever, and it undermines the unity of her units or the lethality or preparation of the military.”
“Without an injunction, she would be released from hospital promptly just because she is transgender,” writes Settle.
Reyes’ ruling to block the policy has been temporarily pending appeals from the government, but it will be effective if “some action occurs” to transmute people in the military.
Thousands of transgender people currently serve in the military, accounting for less than 1% of active service members.
