In a fiery opposition, Judge Sonia Sotomayor argued that for poor school districts it might be too expensive to engage in a lawsuit over funds to track opt-outs and student absences. “Instead, schools may censor the curriculum and strip away material that is at risk of causing religious dissent,” she writes. “In effect, the court’s ruling gives a subset of parents the right to deny curriculum choice to a locally elected school board for a long time.”
