A Manhattan man convicted in 2022 for raping a trans woman in an apartment on the Lower East Side, has been sentenced to 12 years in a state prison.
On August 26th, Encarnación appeared before Judge Kathryn Peck of New York City Criminal Court. amnewyork.
Encarnacion and Evert were neighbors of the apartment building on the same two bridges on the Lower East Side.
On October 9, 2022, at about 10:30pm, Ebert was back in the apartment after dinner with his fiancé and friends.
As she entered the building’s elevator, Encanacion prevented the closure and made progress towards her. Ebert rejects him and says that her fiancé was waiting upstairs. He then stepped inside.
Prosecutors said Encarnación was dressed in Ebert, kissing her and groping for her. As she tried to escape, he chased her down the stairs, pushing her into the ground, raping her.
Evert later called the police to be treated for pain, bleeding and inflammation. Encarnación was arrested soon. amnewyork.
Talking to her attacker in court, Ebert lets Encarnación release her anger and says, “I hate you. You ruined my life.”
After Judge Peck passed the verdict, Manhattan District Attorney Alvin Bragg said testimony in Ebert’s trial was important to help him “ensure the defendant’s accountability.”
“This victim’s night ended with horror when she was brutally raped on the stairs of her apartment building,” Bragg said in a statement. “She continues to suffer from the long-term physical and emotional consequences of this incident and hopes that she will fully heal and recover.”
