The American First Legal Foundation, a right-wing legal organization, has announced that the U.S. Department of Education will allow five Northern Virginia school districts (Arlington, Alexandria, Fairfax, Loudon and Prince William counties) to allow transgender individuals to be allowed to the U.S. Department of Education. They asked to investigate whether the violation is infringing the Use a toilet that suits your gender identity.
Title IX prohibits gender-based discrimination in educational institutions that receive federal funds.
Most conservatives argue that the law should only protect individuals who are discriminated against based on their assigned gender at birth.
However, in Virginia, which is under the jurisdiction of the US Court of Appeals for the Fourth Circuit, the legal precedent is that Title IX protection extends to cases where transgender students are discriminated against based on gender identity. .
American First Legal claim Five school districts have violated President Donald Trump’s recent executive order, preventing schools receiving federal funds from verifying the gender identity of trans students.
If the group is known to all five jurisdictions violate Title IX and refuses to end gender-affirming policies, those school districts will be stripped of all federal funds. It says it should.
“In each of these school districts, “substantial or transgender students” have access to gender general toilets and opposite-sex locker rooms. Because it is consistent with the ability to be safe and comfortable with a subjective sense of “gender identity,” the complaint reads.
“However, other students whose ‘gender identity’ is the same as the biological sexual subjects on the premises, now sexually isolated toilets and locker rooms, have been designated only for gender, For those students, if you are now feeling safe and uncomfortable, the only option is to use a private toilet or a minimizing alternative[s] Loss of education time. ”

In other words, related policies provide students whose “gender identity” does not match biological sex with greater rights than students whose “gender identity” matches biological sex. Therefore, these policies eliminate the concept of biological sex in favour of “gender identity” and “codified discrimination based on gender.”
“If sex is biological sex for the purpose of title IX and you are dealing with, for example, a man who wants to use a female toilet and is uncomfortable for a woman, you need to use a private toilet . And then you, by definition, discriminate based on your biological sex,” Ian Pryor, senior adviser at First Legal, told DC. FOX 5.
Virginia’s largest school district – Fairfax County Public Schools told FOX 5 it complies with federal and state laws.
“FCPS continues to work to promote a safe, supportive, welcoming and inclusive school environment for all students and staff, including trans and gender-enhancing students and staff. ”, the district said in a statement. “We know that students can only learn effectively about who they are when they feel safe, supported and accepted.”
Officials from the city of Alexandria and Prince William County told FOX 5 they would cooperate with the federal investigation but have not been contacted by the Department of Education. The department has not yet announced whether it will investigate the district in response to a First Legal complaint.
