The Christian Right, which seemed too focused on books, toilets, and babies to add another gear to its 19th century wayback machine, is now rumored to be targeting no-fault divorce laws as well. Ignorant Texas Republicans are leading the reactionary attack. Among the many recommendations in their 2024 culture war platform, which also includes eliminating the minimum wage, banning same-sex marriage, and publicly honoring Confederate “heroes,” is a section on no-fault divorce.

Texas family law should be completely rewritten with respect to no-fault divorce and child custody. Litigation over these matters should be mandated to require no more than minimal judicial involvement and to promote the preservation of traditional families through necessary intervention and counseling prior to the issuance of a divorce decree. We urge the Legislature to pass legislation that repeals unilateral no-fault divorce laws in favor of covenant marriages and extends the time period in which divorces can be obtained within six months of the date of the divorce filing.
