Former New York aide Reed Brody is a well-known human rights lawyer known for holding dictators accountable and is currently setting an alarm at home. He describes what he considers as an “unprecedented attack on freedom of expression” in the United States. It is a broad and systematic effort to silence objections (in law firms, NGOs, universities) using all the levers of the government. And this goes far beyond censorship, Brody tells us. “This is a litmus test of submission to Donald Trump,” which is being implemented through corporate pressure and regulatory threats. He pointed to recent incidents like the suspension of Jimmy Kimmel’s show, and CBS’ announcements are expected to close the late show with Stephen Colbert in May 2026 during a $1 billion merger talks with federal regulators. From late-night television to elite universities, Brody argues that opposition is opposed by indirect but intentional means, by misusing all possible loopholes in the law, rather than violating the initial amendment. “What’s going on is much more harmful and dangerous,” he warns rather than violating freedom of speech. It is targeted, refined and obscured with legality.
